Before using Thrive Vision Board & Task App, please read and accept these Terms & Conditions.
1. Agreement
By downloading, accessing, or using Thrive Vision Board & Task App, you agree to these Terms & Conditions. If you do not agree to these terms, do not use the application.
2. Local-First Data Storage
Thrive Vision Board & Task App stores your board data entirely on your own device and browser storage. Random Apps of Kindness does not host, maintain, monitor, or retain a copy of your board data or your backup files.
3. Your Backup Responsibility
You are solely responsible for regularly utilizing the "Back Up to File" feature and securely storing those backup files. If your browser, device, storage, app cache, operating system, or local files are cleared, replaced, damaged, lost, stolen, reset, updated, or otherwise rendered unavailable, your board data may be permanently lost unless you have maintained a separate backup file.
4. Not For Critical, Emergency, Medical, Legal, Financial, Or Life-Saving Use
This application functions solely as a vision board, task board, tracker, and planning tool. It is not designed or intended for emergency response, medical care, legal compliance, financial recordkeeping, safety-critical reminders, life-saving information, or any situation where data loss, delay, or error could result in personal injury, death, or severe physical or property damage.
5. No Warranty ("As-Is" Clause)
The app is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory. Random Apps of Kindness explicitly disclaims all implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, or uninterrupted operation. We do not guarantee that the app will be error-free, secure, or that data will never be lost.
6. Limitation Of Liability
To the maximum extent permitted by law, Random Apps of Kindness and its owners, members, employees, contractors, partners, and affiliates will not be liable for lost data, lost profits, lost opportunities, business interruption, device problems, backup failures, browser storage issues, or any indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the app. In no event shall our total aggregate liability for any claim arising out of or relating to these Terms exceed the amount you paid to download or purchase the app.
7. User Content
You retain all rights to, and are solely responsible for, the content you enter into the app, including text, images, tasks, categories, notes, schedules, shopping lists, and backups. You agree not to use the app to create, store, or promote unlawful, harmful, infringing, abusive, or otherwise unauthorized content.
8. Updates And Changes
The app may evolve over time, which may include modifications to features, design, functionality, prompts, storage behavior, or backup tools. Updates may require you to refresh, reinstall, or accept updated terms to continue using the app.
9. Usage Analytics
The app may use basic website analytics to understand visits, device/browser type, and general app usage. Analytics are separate from your board content. Random Apps of Kindness does not use analytics to read, host, monitor, or retain your personal board data, tasks, notes, images, shopping lists, schedules, or backup files.
10. Governing Law
These Terms & Conditions are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Venue for disputes will be in the state or federal courts located in Travis County, Texas, unless applicable law requires otherwise.
